Legal Guardianship...
Legal guardianship is the permanent transfer of legal responsibility for a child in state custody to a relative or person other than his or her parents. When a child is over 12 years old, they must consent to the guardianship. At age 14, the Court with usually honor their request if it is a "fit" guardian they wish to live with. Many times, if a child has been in the care of the DHHR for a long period of
time (usually more than 6 months), and termination of parental rights is not practical or necessary because another adult (like a foster parent) or a relative is willing to assume custody, then guardianship will often be the right alternative. Legal guardianship offers many of the advantages of adoption, without the necessity of technically terminating a parent's rights.
Like adoptions, there are both private guardianship proceedings and those that involve the Department placing a foster child, often agreeing to pay your legal expenses and subsidizing the placement of the child in that home. Bob did some of the State's first subsidized legal guardianship proceedings when the law first changed after 2001 permitting this type of permanency plan for children.
